Terms of Service

These terms of service ("Terms") govern your use of the TRAINAR mobile application ("the App"), operated by Adam Hessel ("we", "us", "our"). By using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. About the Service
TRAINAR is a mobile application that provides real-time train tracking, traffic information, station departures, and ticket booking for rail services in Sweden and Norway. The App also includes AI-generated traffic summaries, journey search, and travel management features.
2. Account
You can use many features of the App without an account. Creating an account gives you access to additional features such as booking tickets, saving travelers, and storing preferences.
You are responsible for keeping your login credentials secure. You are responsible for all activity that occurs under your account.
3. Ticket Booking
3.1 Our Role
TRAINAR acts as an intermediary for train ticket purchases. When you buy a ticket through the App, the transport contract is between you and the train operator (such as SJ, MTRX, or Vy). We facilitate the booking through our ticketing partner All Aboard.
We are not the train operator and are not responsible for the train service itself, including delays, cancellations, or changes to schedules.
3.2 Service Fee
We charge a service fee on ticket bookings. The fee is calculated as a percentage of the ticket price and is shown to you before you confirm your purchase. By completing a purchase, you agree to the ticket price and the service fee.
3.3 Refunds and Cancellations
Whether a ticket can be refunded or cancelled depends on the conditions of the specific ticket you purchased. Some tickets are refundable and some are not. The refund conditions are displayed at the time of booking.
If you are eligible for a refund, you can request it through the App. Refunds are processed by us and returned using the original payment method.
The service fee may or may not be refundable depending on the circumstances.
3.4 Payments
All payments are processed by All Aboard and their payment provider Stripe. We never receive or store your credit card or payment details. By making a purchase, you also agree to Stripe's terms of service.
3.5 EU Rail Passenger Rights
As a train passenger in the EU, you have rights under Regulation (EU) 2021/782 regarding delays, cancellations, and assistance. These rights apply to the train operator, not to TRAINAR. For compensation claims related to delays or cancellations of the train service, please contact the relevant train operator directly.
4. Real-Time Data and Information
The App displays real-time train positions, departure times, delay information, and AI-generated traffic summaries. This data is sourced from public transport authorities (Trafikverket, Entur) and processed by our systems.
This information is provided "as is" for informational purposes only. We do not guarantee that this data is complete, accurate, or up to date at all times. Real-time data depends on external sources outside our control.
You should not rely solely on the App for time-critical travel decisions. Always check official sources and station displays for confirmed departure information.
5. AI-Generated Content
The App uses artificial intelligence to generate traffic summaries and travel information. This content is generated automatically and may occasionally contain errors or inaccuracies. AI-generated content is clearly labeled in the App.
6. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the operation of the App
- Reverse engineer, decompile, or attempt to extract the source code of the App
- Use automated tools to scrape data from the App
- Resell or redistribute data obtained through the App
We reserve the right to suspend or terminate your account if you violate these Terms.
7. Intellectual Property
The App, its design, features, and content (excluding third-party data such as train schedules) are owned by us. You may not copy, modify, or distribute any part of the App without our written permission.
Train schedule data is sourced from public authorities and remains the property of those authorities.
8. Limitation of Liability
To the fullest extent permitted by applicable law:
- We are not liable for any indirect, incidental, or consequential damages arising from your use of the App.
- We are not liable for missed trains, incorrect travel decisions, or any losses resulting from reliance on data displayed in the App.
- We are not liable for disruptions, errors, or unavailability of the App.
- Our total liability for any claim related to the App is limited to the amount you have paid to us in the 12 months preceding the claim.
Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud or gross negligence.
9. Availability
We aim to keep the App available at all times but do not guarantee uninterrupted access. The App may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
10. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top. Continued use of the App after changes constitutes acceptance of the updated Terms.
For significant changes, we will notify you through the App or by email if you have an account.
11. Governing Law
These Terms are governed by the laws of Sweden. Any disputes arising from these Terms will be subject to the jurisdiction of the Swedish courts.
